Booking & Retainer
A non-refundable retainer of $40 or 25% of the wedding package is required to reserve your session date.
No date is considered booked until:
* Agreement in place
* Retainer is paid
* Confirmation is sent by the photographer
Remaining balances are due seven days before the wedding date or on the day of for other sessions. Failure to complete payment may result in cancellation of services.
Cancellation & Rescheduling
Client cancellations must be made in writing.
* Retainers are non-refundable
* Rescheduling requests require at least 2 days’ notice
* One complimentary reschedule may be allowed at the photographer’s discretion
* New dates are subject to availability
If the client fails to appear, the session is considered forfeited.
Copyright & Image Usage
All images remain the sole copyrighted property of ABrookePhotography
Clients may:
* Print images for personal use
* Share online with credit
* Use for announcements and family sharing
Copyright ownership automatically belongs to the photographer unless expressly transferred in writing.
By booking services with ABrookePhotography, accessing this website, or receiving any delivered images or galleries, you agree to the following Terms of Service. Effective 4.12.25
Terms of Service ABrookePhotography
Refunds, Revisions & Client Satisfaction
Due to the custom and artistic nature of photography services, no refunds will be issued once the photography session has taken place and final images have been delivered to the client.
By accepting delivery of the final gallery, the client acknowledges that the services outlined in the agreement have been completed. If the client has concerns regarding image selection, editing, or final presentation, ABrookePhotography is committed to working in good faith to address reasonable concerns and make limited revision adjustments where appropriate so the delivered work aligns with the agreed-upon style and expectations discussed prior to the session.
Revision requests must be submitted within 14 days of gallery delivery and are limited to reasonable editing adjustments.
Refunds will not be granted due to:
* Personal preference changes after delivery
* Dissatisfaction with poses, expressions, outfits, locations, weather, or participant cooperation
* Failure to communicate requested style preferences before the session
* Requests made after the revision window has passed
Delivery, Gallery & File Storage
Final images will be delivered within two weeks via online gallery unless otherwise agreed. RAW or unedited files are not included and will not be delivered. Delivered galleries remain active for 365 days. The client is responsible for downloading and backing up all images before expiration. Long-term archival is not guaranteed.
Limitation of Liability
In the unlikely event of illness, emergency, equipment failure, acts of God, venue restrictions, or circumstances beyond the photographer’s control, liability is limited to the amount paid by the client.
The photographer is not responsible for:
* Missed shots due to client lateness
* Venue restrictions
* Weather conditions
* Interference from guests or vendors
* Loss caused by third-party print labs
Governing Law
These Terms of Service shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be handled in the appropriate courts of Lubbock, Texas.
Changes to Terms
ABrookePhotography reserves the right to update these Terms of Service at any time. Continued use of services or this website constitutes acceptance of any revisions.
